A decision that could settle the lawsuit filed by Steve and Jean Rothrock against the City of Georgetown and some local officials will be decided by city council and not the Architectural Review Board.
Originally, the ARB was supposed to take up the issue this week of whether the Rothrocks could place HardiePlank on three sides of their Cannon Street home.
But, the matter has been moved to the next city council meeting and that panel will make the decision.
The Georgetown Times has been told the approval of HardiePlank on three sides of the house is one of the agreements both sides reached in their talks to settle the lawsuit that was filed last year.
A source also says the city has agreed to pay the Rothrocks $250,000.
The suit asked for a court order demanding the City release the necessary permit to allow completion of the home at 116 Cannon Street with HardiePlank siding.
The city’s Architectural Review Board has repeatedly denied requests for HardiePlank siding for the home.
City Council will meet Thursday, Sept. 20.
